U.S. show jumper Paige Johnson has been suspended for one year following a Fédération Equestre Internationale Tribunal decision on the banned substance pramoxine.

Samples taken from Salamander Farm’s Luke Skywalker 46 on Jan. 21 at a CSI** in Wellington, Fla., showed the presence of pramoxine, a local anesthetic.

Johnson had been provisionally suspended from April 5 for three months, so she will not be eligible to compete until April 4, 2018. The Tribunal also imposed a fine of 2,000 Swiss francs (about $2,072) and contribution of 3,000 Swiss francs ($3,108) toward legal costs.

Johnson has appealed the decision to the Court of Arbitration for Sport. In the report, Johnson’s groom of 15 years, Sergio Molinero, testified that he bought a triple antibiotic wound cream that caretakers at Johnson’s Salamander Farm had used for years to treat minor wounds and cuts.

On a trip to Walmart he bought four tubes of what he thought was the ointment they commonly used, which was known to be safe for FEI competition use. He realized after he had treated a minor cut on Luke Skywalker’s flank before the competition that he bought a version with pain relief that included pramoxine.

While Johnson testified to her meticulous barn management and attention to FEI rules at her Salamander Stables in Middleburg, Va., and Wellington, the FEI decision stood due to the presence of the banned substance and because Johnson was the person responsible.

“I’m obviously sad not to be competing right now,” said Johnson, 31. “I love my horses, and I love this sport, which I’ve been a part of for almost 24 years. I’m disappointed that an honest mistake carries such a severe penalty for the rider.”

Paige Johnson free to resume her career with immediate effect

Morgan Sports Law acts for equestrian rider, Ms Paige Johnson, in her successful appeal to the Court of Arbitration for Sport (“CAS”) against a one-year ban imposed on her by the Fédération Équestre Internationale (“FEI”). 

Summary

In April 2017, Ms Johnson was suspended from competition after being notified that a Banned Substance had been detected in a sample collected from her horse, Luke Skywalker 46, in February.

An Independent Panel of the FEI imposed a one-year ban on Ms Johnson, following which Ms Johnson instructed Morgan Sports Law to represent her in her appeal to CAS.

Ms Johnson’s suspension was subsequently reduced to three (3) months, backdated to February 2017. Accordingly, Ms Johnson is free to resume her riding career with immediate effect.

Paige Johnson has always been a visionary – at first, maybe a little too much of one.

“When I was very little, I thought I would have a farm full of elephants – an exotic animal sanctuary. I thought there might be miniature elephants by the time I was old enough to do it, and I wanted those, too. I was probably six years old!” Paige recalled, laughing at the thought. “Growing up a little bit, reality sank in, and I realized there would be no miniature elephants and no elephant sanctuary!”

But that didn’t mean Paige, now 32, still didn’t think big. She got hooked on horses and went on to compete at the international levels of show jumping, training with the likes of the legendary Bill Maroney and Joe Fargis – as well as the growing legend that is Kent Farrington – and successfully competing both stateside and abroad.

"I wanted to help give dogs a voice..."

But while fully immersed in a business-oriented industry where horses change hands often, Paige isn’t afraid to remain a self-proclaimed “horse collector.” Her junior jumpers and first grand prix mounts return to her farm in The Plains, VA, to live out their days. The desire to give animals a safe haven and a forever home has now transferred to a smaller four-legged species – of the canine variety.

“I’m the person that cries watching the Lion King when Mufasa dies,” Paige said. “I have a huge love and respect for animals; I love them more than anything. I wanted to help give dogs a voice and do more. If I could save all the animals in need, I would.”

Paige has been working to establish “Their Voice Rescue,” a non-profit 501(c)(3) animal rescue, for the past two years. Focused on rescuing, rehabilitating, and rehoming high-risk dogs from kill shelters around the country, the rescue is now up-and-running in Delaplane, VA.

“When I do something, I do it all the way – 100 percent,” Paige said. “I’d been donating [to different charities] for a while, including the David Sheldrick Wildlife Trust, where you can ‘foster’ an animal like an elephant or rhino. Money goes a long way, but at some point, I wanted to do something more hands-on.”

Paige, who is also an EQUUStar through the Equus Foundation, thus began researching how she could help animals in her area. A dog lover as much as a horse lover, she received advice from friend, fellow show jumper and active dog rescue advocate Georgina Bloomberg on how to best help canines in need.

“Georgina gave me a lot of helpful advice,” Paige said. “That’s my girl! I see what she does, and she inspires me. I thought, ‘What can I do?’ I’m in Virginia and can actually have a facility. I can do something.”

The search for the perfect property was perhaps the most difficult part of the endeavor. After the acquisition of one land parcel fell through, another larger piece of real estate finally revealed itself in November. Their Voice Rescue is now based on 50 lush acres.

“We have a good team right now,” Paige said. “The dogs look amazing and are so happy.”

What started as just a single family home and lots of land has now been developed with kennels built by Horizon Structures of Chester County, PA, ironically located near Harrisburg’s Pennsylvania National Horse Show. Doggie residents are evaluated by vets, go for leashed walks, and have play time with both humans and their rescue companions, running in the open spaces of the fields and getting wet ‘n wild in kiddie pools. Currently, eight dogs are enjoying the premises, with seven ready for adoption (Paige started with 12 dogs, and three have already been adopted). Paige hopes to gradually expand the size and scope of her operation to accommodate 30 dogs at a time.

“It’s hard work, but it’s rewarding work"

“We’re allowed to have up to 30 dogs to start with our first license. I hope to steadily grow to that number,” Paige explained. “It’s really important to me that each dog gets the individual care and attention it needs, and we’ll gradually hire more people.”

Paige communicates with other dog rescue organizations and shelters and scouts out dogs that she thinks will best fit in Their Voice Rescue’s program – temperament plays a big role. She likes to seek out kill shelters in financially unstable areas to rescue the most at-risk dogs, which are then transported north to Delaplane. A recent rescue was done through the Tri-State Pet Rescue in Georgia – the experience brought Paige a sense of reward she had never before experienced.

“It’s amazing,” she said. “It’s hard work, but it’s rewarding work. You can’t give up. What we want to be is an amazing layover location for dogs until they can find a forever home. Seeing them get adopted is a ‘Yes!’ moment. It gets me thinking about what might have happened if we didn’t get to them. They all deserve that chance.”

Johnson, 31, an acclaimed rider who became the first black American to win a major grand prix in 2015, first suffered the setback when her horse tested positive for Pramoxine in January.

Her groom says it was all his fault.  According to International Federation for Equestrian Sports (FEI), groom Sergio Molinero says he went to Walmart to grab the usual antibiotic cream they used to treat small cuts on her horse, Luke Skywalker 46.

The Palm Beach Post reports Molinero has been Johnson's groom for the past 15 years and has been working with Luke Skywalker since they bought him in 2015.

Molinero told the FEI he accidentally grabbed the tube with the banned substance. 'I was buying the same triple antibiotic we always buy, which is OK under the anti-doping rules.'

'I now realize after Paige was able to find my receipt for the purchase that I made a mistake and pulled the wrong tube off the shelf because it looked so much like the one we always use' Molinero told the FEI. 

In the FEI report, Skywalker's veterinarian John Nolan called Johnson 'the most careful and ethical rider with whom he had ever worked.'

    USA's show jumping rider, Paige Johnson has been suspended for one year and fined 2000 Swiss francs as well as 3000 Swiss francs for the judicial procedure by the FEI Tribunal after her horse Luke Skywalker 46 was tested positive during the Wellington Equestrian Festival CSI2* Jumping in January earlier this year.

     

    She will receive credit for having served more than three months of a provisional suspension, imposed following confirmation of the positive test.

    The case involved the horse Luke Skywalker 46, ridden by Johnson in a CSI2* jumping event in Wellington, Florida, from January 17 to 22.

    Blood and urine samples were taken from the horse on January 21 for testing.

    The testing revealed the presence of pramoxine, a local anaesthetic used to relieve pain and itching. It is classified as a banned substance under the FEI Equine Prohibited Substances List.

    The tribunal was told that Luke, like all horses, got the occasional minor cut and a veterinarian had recommended the use of a triple antibiotic cream in such cases, which the vet had indicated was OK under the anti-doping rules provided it did not contain added corticosteroids or pain relief.

    A groom, Sergio Molinero, told of going to Walmart on January 5 this year, where he took four tubes of the antibiotic cream off the shelves for purchase.

    “I was nsr soccer complaints the same triple antibiotic we always buy which is okay under the anti-doping rules, paige johnson equestrian. I now realize after Paige was able to find my receipt for the purchase that I made a mistake and pulled the wrong tube off the shelf because it looked so much like the one we always use,” his written submission said.

    “I now see that I mistakenly bought triple antibiotic with pain relief, and the pain relief contains pramoxine.

    A veterinarian, Dr John Nolan, also provided an account, saying that Johnson was meticulous about her procedures in the barn and continually demanded a higher level of caution than even he recommended.

    He said he had worked with many professional equestrian athletes over the years, and he could say without reservations that Johnson was the most careful and ethical rider with whom he had ever worked.

    He confirmed that he had advised Molinero that he may use a triple antibiotic on the horse, “but he should avoid any corticosteroid or pain relief in the ointment.”

    Regarding fault, Johnson, represented by Lisa Lazarus, argued that she did not breach any duty of care. The evidence showed that her policies and procedures involved an exceptionally high level of care and responsibility, as confirmed by Nolan.
